1. Definitions

In these Terms and Conditions:

• "Vellumark", "we", "us", "our" means Vellumark, operating from 7/21 Huay Kaew Road, Suthep, Chiang Mai 50200, Thailand.
• "You", "Client" means the individual or family engaging our services or using this website.
• "Services" means the document organisation, legacy reflection workshop or family archive creation services described on this website.
• "Agreement" means these Terms and Conditions together with any written service confirmation we provide to you.
• "Materials" means any documents, photographs, heirlooms or other items you provide to us in connection with the Services.

2. Acceptance of Terms

By submitting an enquiry through our website, by corresponding with us, or by engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or engage our services.

Our services are intended for adults aged 18 and over. By engaging us, you confirm that you are at least 18 years old and have the capacity to enter into a binding agreement.

3. Service Description

Vellumark offers three personal organisation services:

Services are available to clients in Thailand. We will confirm the scope of each engagement in writing before work begins.

4. Your Responsibilities

To allow us to carry out the Services effectively, you agree to:

• Provide accurate information about the records and materials you wish to organise.

• Confirm that you have the right to share any Materials with us and that doing so does not infringe the rights of any third party.

• Make yourself reasonably available to answer questions during the course of the work.

• Use our website and services only for lawful purposes and in a manner consistent with these Terms.

5. Intellectual Property

All content on this website — including text, images, layout and design — belongs to Vellumark or our content suppliers and is protected by applicable intellectual property laws. You may view and print pages for your personal, non-commercial reference only.

Any Materials you provide to us remain your property at all times. We use them solely to carry out the agreed Services and do not reproduce, distribute or use them for any other purpose.

6. Fees & Payment

Fees are as listed on our website and confirmed in writing for each engagement. All prices are quoted in Thai Baht (฿) and are inclusive of applicable local taxes unless otherwise stated.

Payment terms will be set out in your service confirmation. We typically request a deposit before work begins, with the balance due on completion.

Refunds: If you cancel before work begins, your deposit will be returned in full. Once work has commenced, we will discuss a fair adjustment based on the portion of work completed. We will always aim to reach an outcome that feels reasonable to both parties.

7. Confidentiality

We understand that the materials and information you share with us are personal and often sensitive. We treat all client information with care and discretion.

We will not disclose your personal information or the contents of your Materials to any third party except as required to carry out the Services (for example, a secure storage provider) or as required by Thai law. Any such third parties are required to handle your information with an equivalent level of care.

8. Disclaimers

Our services are personal organisation and educational services only. We do not provide financial, legal or professional advice of any kind. Nothing we say or produce in the course of our services should be understood as advice requiring a licence or professional qualification.

Our website is provided on an "as available" basis. We do not promise uninterrupted availability and reserve the right to modify or withdraw the site at any time.

9. Limitation of Liability

To the extent permitted by Thai law, Vellumark's total liability to you arising out of or in connection with these Terms or the Services shall not exceed the fees paid by you for the relevant Service.

We are not liable for any indirect, consequential or incidental loss arising from your use of our services or website.

Nothing in these Terms limits or excludes our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under Thai law.

10. Termination

Either party may end a service engagement by giving reasonable written notice. If you choose to end an engagement that is underway, we will agree a fair settlement for the work completed to that point.

We reserve the right to decline or discontinue services where doing so is necessary to comply with applicable law or to protect the interests of either party.

11. Dispute Resolution

These Terms are governed by the laws of Thailand. If a concern arises, we ask that you contact us first so that we can try to resolve it informally and amicably. Most misunderstandings can be resolved with a calm conversation.

If informal resolution is not possible, disputes shall be subject to the jurisdiction of the competent courts of Chiang Mai, Thailand.

12. General Provisions

• Entire Agreement: These Terms, together with any written service confirmation, constitute the entire agreement between us in relation to the Services.
• Severability: If any part of these Terms is found to be unenforceable, the remainder will continue in full effect.
• Waiver: Our failure to enforce any provision of these Terms on any occasion does not constitute a waiver of that provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.

13. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last Updated" date when we do. Continued use of our website or services after an update constitutes acceptance of the revised Terms. If a change materially affects an ongoing engagement, we will let you know directly.
